“双置换”中土地权益问题探讨

为了解我国各地正进行的＂双置换＂政策中的土地问题,调查了苏南W市L村的＂双置换＂过程,通过问卷和访谈的方式分析个中集体土地所有权及各项权能在置换中的实际变动情况,发现这种置换使得集体所有权主体和部分权能转移,同时土地承包权去向不明等。尽管这项政策能较快提高土地集约利用率,推动当地农业发展,但是必须要考虑农民长远利益及各项应得权益。

Discussion on Land Rights and Interests in the Process of "Double Replacement"

To explore the "Double Replacement" policy concerning land issue in China,the paper investigates the process of "double replacement" of L village of W city located in the southern part of Jiangsu province.Based on questionnaire and interview,the paper analyzes the actual change of the property rights and the functions of collective land.It is found out that such replacement makes the subject of the property rights of collective land transfer and lets contractual rights of land be indefinite.Although the "Double Replacement" policy may improve the utilization efficiency of land and promote the development of agriculture,it pays less attention to the long-term interests of the farmers.
