| 摘 要： | 2009年10月1日实施的《保险法》中,对于保险利益的规定符合了保险实务的需要,具体的变化主要有两点：一是在保险利益的规制对象上增加了被保险人,二是根据不同的险种而使得保险利益的存在时间不同。但其中对保险利益的规定过于原则,而且对于保险利益的丧失问题和同意原则的取舍问题没有明确说明,需要进一步的立法完善。

| Abstract: | The regulation for insurance interests conformed to the need of insurance practices with the implementation of the Insurance Law on October 1,2009.There are two main improvements in the law.First,the insurant was included as a prescribed object.Second,the existing time of insurance interests was set up differently according to the coverage of the insurance.However,insurance interests prescribed in the law are not operational.Problems about loss of insurance interests and how to choose consent principle should be solved in further legislation. |
