| 摘 要： | 生态环境的保护与改善是和谐新农村建设的重要内容。当下农村生态恶化现状催生了农民对环境权需求的萌动，农民环境权是对消解中的桃花源复归的权源对接。在对环境权与农民环境权作景象概览与价值评判的基础上，深度审视当前我国农民环境权的法律保护现状，以权利的应然与实然级差为视角，作出了对农民环境权本体法律化的科学预设。

| Abstract: | The protection and improvement of ecological environment is an important issue in the construction of the new socialist rural area. The current deterioration of ecosystem in the rural stir up farmers to pursue environmental fight, and rural environmental right is the demand for the return of the Peach Blossom Garden. Based on evaluation of present condition of farmers＇ environmental right, the author illustrated the current situation of legal protection of farmers＇ environment rights, and made a scientific presupposition of establishing law about farmers＇ environmental right from the angle of granted rights and actualities. |
