| 摘 要： | 中国司法传统中蕴含着平衡、和谐的智慧,它以社会秩序的稳定和谐作为理想的价值目标.而目前在西方兴起的恢复性司法运动,在价值理念上与儒家的平衡和谐思想与调解制度有诸多近似之处,而这也正是中西法律文化可以汇通的地方.它们对我们今天构建和谐社会均有借鉴意义.

| Abstract: | Chinese judicial tradition contains a balanced and harmonious wisdom,which regards the stable and harmonious social order as an ideal value goal.At present,the restorative justicemovement arising in the West,in terms of its value ideas,has a lot in common with Confucian ideology of balance and harmony and mediation system.And this is precisely where Chinese and Western legal culture can get access to communicating with each other,which can be used for reference in establishing a harmonious society today. |
