| 摘 要： | 同人二次创作作品作为原作品的二次衍生作品,一向处于著作权保护的灰色地带。一方面,二次创作作品被认为是对原作品及作者权利的侵犯;另一方面,由于此种认知,使作品的价值无法得到确认,更无法得到应有的保护。本文对同人二次创作作品的构成进行分析,并对赋予同人二次创作作品著作权的正当性及其保护价值进行了探讨,最终确认其应当受到著作权制度的保护。

| Abstract: | The fan recreations,as the derivative works of the original works,are always in the gray areas of copyright protection.In fact,they are considered as an infringement of copyrights on the original works and of the authors’ rights.Therefore,their values can not be confirmed and not be able to be protected properly.This paper analyses the composition of fan-fiction recreations,and discusses its compatibility with the value of the copyright system.And finally it is verified that they should be protected by the copyright system. |
