论影视角色商品化权的法律保护

摘    要:“刘老根”商标抢注现象引发了人们对影视角色商业性使用问题的关注。经深入探究发现,这里存在的权利并非传统意义上的知识产权,而是一种新型权利——影视角色商品化权。对影视角色商品化权的概念进行界定,指出其在商品化权中的位置,讨论现有影视角色商品化权保护模式存在的法律缺陷,并据此提出我国影视角色商品化权保护体系的构建设想。

Abstract:The trademark registration phenomenon of "LIU Lao-gen" attracts the attention of commercial use of film and television characters. Through deep exploration and analysis, it is found that this right is not the traditional intellectual property right, but a new type of right:merchandising right of film and television characters. The concept of merchandising right of film and television characters is defined, the status of it in merchandising right is pointed out, the legal shortages of existing protection mode of merchandising right of film and television characters is discussed, and the constructing idea of protecting system is proposed to the merchandising right of film and television characters in China accordingly.
