强行性规范及其法律适用

调整交易关系背景下民事主体的利益与公共利益之间的关系,有赖强行性规范。依据其功能的不同,强行性规范可分为强制性规范和禁止性规范。违反法律、行政法规强制性规范以及管理性禁止性规范的合同行为并非绝对无效的合同行为,违反效力性禁止性规范的合同行为方属绝对无效的合同行为。

On Compulsory Norm and Its Legal Application

Adjusting the relationship between civil subject's interest and public interest in the background of trade relationship depends on compulsory norm,according to whose function there is the difference between mandatory norm and prohibitive norm. The contract that breaks law,mandatory norm of adminstrative regulation and administrative prohibitive norm cannot guarantee it invalidity,while the contract that breaks effective prohibitive norm must be invalidity.
