| 摘 要： | 我们在遏制职务犯罪的斗争中,经历了一个从侧重刑罚的惩治到打防并举的历程。随着联合国《打击跨国有组织犯罪公约》的生效和《反腐败公约》的拟定,国际刑事法界强调了预防职务犯罪的新理念。由此出发,我们也应在防治职务犯罪的理念转换、动员全社会总体力量参与预防的方式、开展规范的预防工作、强化法制化轨道的预防立法和加强国际间预防工作合作等五个方面对我们现行的防治职务犯罪理念进行梳理和重构。

| Abstract: | In the struggle of containing the post crime,we have experienced from stressing punishing by crinimal law to both striking and preventing.Convention of striking Transnational Organized Crime coming into effect and Convention against Rotting being made by UN,the internationl criminal law organizations exphasise the new logical view of post crime.So we sort out and rebuild the logical view of preventing post crine from the following five sides:to change the logical view of preventing post crime,to call for the whole society take part in ,to prevent normally,to strengthen legal preventing and to strengthen cooperating transnationally. |
