抢劫毒品行为的定性与定量分析

目前司法解释将抢劫毒品行为认定为抢劫罪，不如刑法将其独立成罪；司法部门以当地毒品非法交易价格确定抢劫数额，不如根据毒品数量对应不同等级的法定刑；参照抢劫罪加重法定刑等级，多次抢劫毒品行为应当成为升格法定刑的条件。犯罪形态如何，并不影响法定刑升格条件的犯罪次数认定。抢劫毒品多次与毒品数量竞合的，适用处罚较重的情节，抢劫既遂与抢劫未遂的数额不能累计计算，不同毒品种类累计可予依法折算。
