| 摘 要： | 美国宪政思想对近现代的德国影响源远流长，它在公民的基本权力、联邦制度以及设立魏玛共和国民选总统等方面对魏玛宪法产生了深刻影响。具体说来，魏玛宪法深受美国宪法十条修正案的影响：在魏玛宪法的国京组织结构中，联邦国家被保留下来，而美国宪政因素对国家元首和总统设立制度的影响，则主要通过德国著名社会学京马克斯·韦怕的主张体现出来。
