情报与情报公开法的概念探讨

情报一词,经历了从窄到宽、从专用到通用的变化。情报与信息有别,在政府或行政的情况公开方面,使用情报一词更为恰当。行政情报,应当包括行政机关及其公务员在履行职责中制作、取得或管理的文书、图画以及电磁等非常规载体所作的记录。情报公开,指国家机关掌握的情报向公众公开,包括主动公开和依申请公开。情报公开法,是国家或地方公共团体集中规定公众的知情权和行政机关及其他国家机关的公开情报义务的立法总称。

Study On the Conception of Information and Public Information Law

The meaning of the word Information has changed a lot as time goes on and there is difference between information and message. As far as government or administration unit is concerned, it is appropriate to use the word Information. Administrative information should contain documents, pictures and notes by irregular carrier. The public information means the information of government that should be known to the public. The Public Information Law is the legislation drafted by the government and organizations about the right of knowing the information for the public and the duty of revealing the information by those administrative units.
