| 摘 要： | 《物权法》对拾得遗失物制度的规定有三点缺陷:一是与该制度在我国的历史发展趋势相悖;二是拾得人的权利义务的规定与大多国外立法例不同,尤其是无人认领的遗失物归国家所有为极少数国家采用;三是遗失物拾得人的权利义务失衡。对该制度的完善是增加遗失物拾得人的保管费用请求权和报酬请求权以及在一定条件下取得遗失物的所有权。

| Abstract: | 《the Law of Property 》has three deficits in regulation of picking up loss system. First it is contrast of chinese historical development. Second the regulations of d roit and obligation about collector are different from forign, especially few countries adopting the system that the loss belong to government if nobody claim it. Third the right and obligation of collector are not balanceable. The reinforce to this system is to add claim for collector＇s custodial fee and rewards and for loss＇ s ownership in special situation. |
