| 摘 要： | 对"马克思主义法学"的理解,不应该仅仅局限于传统意义上的认识,而应该从马克思主义追求人类普遍解放的终级目标中看到,以人为本也是马克思主义法学应有之义;应以发展了的马克思主义为指导,不断丰富和发展马克思主义法学的内涵。马克思主义法学中国化不单是马克思主义法学的中国化,更应注意马克思主义理论对马克思主义法学中国化的指导作用。马克思主义法学中国化的研究不应仅仅关注政治层面的党和国家领导人的法律思想,还应从学术层面来探究其理论体系、结构和内容。马克思主义法学中国化与马克思主义中国化研究的差异性也不应忽视。

| Abstract: | In the Context of Marxist law sinicization,Marxist law should not be only limited to the traditional concept of law.Due to Marxist ultimate goal is to pursue to universal human liberation,equality and freedom,the legal concept of people-oriented should be taken as the essence of Marxist law.And,Marxist sinicization theory is the guiding ideology of Marxist law sinicizationn.Marxist law sinicization should be studied at both the political level and the academic level.In addition,the difference between Marxist law sinicization and Marxist sinicization Chinese-characterization should be attached much attention. |
