高等学校管理是维护学校秩序、保障学校生活良性运行,培养德智体全面发展人才的重要条件。随着高校改革的深入,学校与学生之间的关系也在发生深刻的变化,在某些方面出现了过去未有的矛盾和问题。近几年来,高校在其管理中侵犯大学生权利的现象时有发生,大学生状告学校侵权的法律纠纷也呈上升趋势。如何运用法律的观点分析、认识学校和学生之间的关系,如何使学生管理工作走上科学、规范的“法治”轨道,在完善高校管理的同时保护大学生合法权利,成为一个亟待解决的问题。

College management is an important precondition of campus order, regular school life and cultivation of overall developed talents. With the thorough reform of advanced schools, profound changes have taken place between school and its students,and some unprecedented contradiction and problems have occurred in some fields. In the last few years, the campus management occasionally has infringed on students' rights, which brought more and more lawsuit to schools. Therefore, it is urgent to learn how to analyze the relationship between school and students from legal point of view, regulate and perfect college management and protect students' legal rights.
