| 摘 要： | 日本2007年底通过了《劳动合同法》，将既有的劳动合同相关判例法理明确和成文化，日本的《劳动合同法》虽然内容比较简单，但是其确定的权利不得滥用等原则和规定仍然值得我国借鉴。

| Abstract: | In 2007,Japan had promulgated the Labor Contract Act,which made the existing cases on labor contract more clear and statutory.Though the contents of Japanese Labor Contract Act is simpler than ours,the principles it stipulated such as the prohibition on the abuse of rights can give us some highlights. |
