论永佃权在完善我国农地使用权制度中的价值

中国问题,在很大程度上是农民问题,而农民问题又主要是土地问题。永佃权制度作为改革现今农地使用制度的有益借鉴,已为许多学者所肯定。但永佃权制度与农地承包经营权制度在具体制度上如何对接,仍有进一步研究的必要。我们认为,两种制度对接的基础是两者间诸多的共同性;依据永佃权制度,现行制度下"三提五统"的征收,应以土地收益的一定比例为依据,而不是以全村农民的收入为标准;当永佃权在被赋予了物权性质的权利之后,农地主体间的利益不平衡问题,能够得到较为妥善的解决。

On the Value of Emphyteusis in the Course of Perfecting the System of Rural Land Usage

The problems in China are mainly peasantry problems,of which the main part is the problem of the land in village area.Generally speaking,it is popular to the researchers in this field that emphyteusis shall be the substitute for the tenancies right in the rural land usage.The thesis argues that it is necessary to further study the shifting of the tenancies right in the rural land usage to emphyteusis.Then,the thesis makes comments on the value of emphyteusis both in the reform of the taxes and fees system and for the balancing of interests of the state,the collective and the peasantry.
