试论新宪政论对传统宪政论的拓展

新宪政论源于传统的政治科学,但又突破了传统的宪政论。具体来说,新宪政论与传统的宪政论相比,在其理论支撑、人类动机理解角度、价值取向、制度范围和宪政目标等方面都有了明显的拓展。新宪政论为我们提供了一个全新的研究视角并带给我们启迪,对中国的宪政建设实践具有一定的借鉴意义。

The New Constitutionalism as Development of Traditional Constitutionalism

The new constitutionalism derives from the traditional political science,but at the same time it also makes a breakthrough.In comparison with traditional constitutionalism,the new constitutionalism shows an obvious expansion in the aspects of theoretical basis,reasonable angle to comprehend human motives,value tendency,scope of system,constitutionalism targets etc.New constitutionalism,as a categorized hermeneutic frame,provides us with a new perspective of inspirations and therefore is of practical reference to the construction of Chinese constitutional policy.
