| 摘 要： | 地方政府立法协作是解决地方政府立法碎片化和构建统一协调的区域法制环境的主要途径。本文在阐释地方政府立法协作的主体、形式和法律界限，分析协作的必要性和合法性的基础上，对实现地方政府立法协作的拘束型模型和契约型模式进行剖析。相对于拘束型模式，契约型模式对现行完政体系和行政框架的冲击力要小得多，具有较强的操作性，但其中的磋商沟通机制和行政协议机制的效力还有待法律的进一步明确。

| Abstract: | Legislative cooperation among local governments is a main method to resolve the local legislation fragmentation and construct the uniform and harmonious legal environment.This paper firstly explains the main body,form and legal boundary of legislative cooperation among local governments,and demonstrates the possibility and legality of cooperation,and then analyzes the constraint mode and contract mode of realizing legislative cooperation.Relative to constraint mode,contract mode has good operability because the impact of it upon present constitution system and administrative frame is little.However,the negotiation system and the effect of administrative agreement of contract mode remain to be confirmed. |
