务宜远人：明朝藏地僧俗贡使违规私茶处罚的立法与实践

与明朝茶禁无论是茶立法上,还是执法实践中,严厉惩治把关将吏失职及自营和茶商违禁相比,对藏地僧俗兴贩和夹带等违制行为,其立法相对粗略,处惩力度不仅较轻,而且极为灵活。这种双重评判标准的立法与因地域因人事的实践操作方式,实质上,充分显现出明朝有别于元清的治藏特色,就是要以经济手段“联番制虏”,促使并强化藏区政治内向。
