对地方立法中确立终局鉴定的思考

本文对当前地方立法机关在鉴定立法过程中规定司法鉴定委员会的鉴定为终局鉴定 ,部分地方规定不同鉴定机构作出的鉴定结论具有不同证明力的作法提出质疑。认为这类作法 :首先 ,违背认识论 ;其次 ,违反有关法律 ;其三 ,违背司法实际 ;其四 ,司法鉴定委员会的性质不宜作出终局鉴定。最后 ,作者指出应以强化鉴定人出庭对鉴定结论的质证作为解决当前问题的出路。

Thinking on the Eventual Authentication Establishment in the Legal Proceeding

Authenticating conclusion is one kind of evidences provided by the law It plays an important role in the legal proceedings In China, there is a certain disorder in practice because of lack of the united law on the judicial expertise In order to resolve this problem, several provinces or municipality lay down some statutes to regulate the authentication Some of them provide that the authentication of the committee on judicial expertise be the eventual authentication with the highest authority Some also stipulate the rank of the authenticating conclusion The author doesn't think that it should be reasonable and sets out his reasons At last, the author points out that the examination of the authenticating conclusion be the key to solve the problem
