“保护的责任”的运用及扩散——以规范的发展过程为中心

当今国际社会从未停止过对人权和主权之间张力的反思,"保护的责任"这一概念应运而生。这一尚待完善的概念得到了国际社会和国际法以及国际关系学者的关注和讨论。以国际关系规范理论为基础,可以分析"保护的责任"这一概念的产生和发展成为国际社会一个新规范的过程。本文以中国为例,考察了"保护的责任"在中国扩散的原因以及中国如何灵活地处理这一规范与"不干涉主义"之间产生的张力。由此分析可得,国际规范的创制和扩散是国际社会与个别国家之间互动的结果,而在这一过程中国家本身对规范背后的价值认可至关重要。

Exploring ＆quot;Responsibility to Protect＆quot; and Its Diffusion in International Society——Focusing on the Diffusion Process of Norm

Scholars and politicians have never stopped considering the tension between sovereignty and human right in contemporary international society. The concept of ＂Responsibility to Protect＂ attracts a great attention and has been discussed by academia of international law and international relations. Based on the norm theory of international relations, this paper analyzed the process how this concept has been born and has become a new norm in international society. Through the China＇s case, this paper elaborates the reason why this concept has diffused in China and discusses that China deals flexibly with the tension between the concept of ＂Responsibility to Protect＂ and ＂non-intervention principle＂. The conclusion is that the creation and diffusion of international norms is the consequence of the interaction between international society and an individual country. In this process of the birth of a new norm, it is critically important that individual country recognizes the value underlying the international norm.
