对侦破刑事案件引入招投标制的经济学思考

针对当前公安部门办案存在的问题 ,有人设想在其内部采用招标的方式 ,以提高办案经费的使用效率和破案率。在委托代理的理论分析框架下 ,采用招标的方式 ,以赋予中标干警剩余索取权 ,激励其提高努力程度 ,从而提高办案经费的使用效率和破案率的机制 ,在干警的风险偏好程度及其预期允许的前提下才有可行性 ;在实践中 ,较大的交易成本也影响了这一机制的作用。

Economic Consideration on Introducing Tender System into Criminal Case Investigation

To increase the economic efficiency and criminal case-cracking rate,someone conceived the mode of tender system within police forces to solve some of the problems in handling the cases. By theoretic analysis of the framework of agent commission,the mode of tender gives the surplus benefit to the policemen who got the tender,stimulates their efforts,therefore increases the economic efficiency and case-cracking rate. However,the mode is only feasible under the premises of risk preference in the policemen and expected permission degree. In practice,considerably higher trade-off cost affects the functioning of the mechanism.
