| 摘 要： | 我国刑法将交通肇事后逃逸行为规定为交通肇事罪的加重处罚情节,在立法上存在严重缺陷,刑法应当借鉴其他国家或地区的相关规定,将交通肇事后逃逸行为规定为独立的犯罪。

| Abstract: | Chinese criminal law regards the escaping behavior after traffic accident as a crime of accident to be punished more severely. It is a flaw in legislation and also brings much inconvenience in application. To make a compensation for this ,we must deal with it appropriately in practice and refer to other countries' rules and treat the behavior of escaping after traffic accident as an independent crime. |
