非物质文化遗产知识产权保护之殇:"汤瓶八诊"系列案评析

"汤瓶八诊"系列案反映出我国非物质文化遗产保护与知识产权制度在理论与现实上存在着紧张关系.这种紧张关系是由于我国非物质文化遗产相关法制不健全和不完善而导致的,它主要体现在司法机关、行政机关在处理非物质文化遗产相关知识产权问题时存在观点、思路差异."汤瓶八诊"系列案亦反映出我国亟须明确和厘清非物质文化遗产传承人是否拥有私权利、知识产权制度在非物质文化遗产保护中的角色等问题.通过修改《非物质文化遗产法》(2011)等有关知识产权条款,明确非物质文化遗产传承人拥有包括知识产权在内的私权利及其他权利类型,改良知识产权权利及创新知识产权制度,将在某种程度上缓和我国非物质文化遗产保护与知识产权制度之间的紧张关系.

The cases of diagnosis and treatment method named"tangpingbazhen"imply the intense relationship between the theory and practice in the field of intangible culture heritage protection and the regime of intellectual property.And the imperfect and incomplete of legislation in the field of intangible culture heritage results in this situation and reflects that the difference on the viewpoint and thoughts in competent authority and judicial authority facing with the issue of intellectual property relates to the intangible culture heritage.The cases also imply that China should clarify whether the inheritor have private right and the role of regime of intellectual propertyor not,ect.To revise the clause which relates to the intellectual property in Law on Intangible Culture Heritage(201 1),and to clarifythat the inheritor have private rights,including intellectual property,and improving the regime of intellectual property and creating regime of intellectual property may remit the intense relationship in the field of intangible culture heritage protection and the regime of intellectual property,to some extent.
