搜索引擎服务商著作权侵权问题探析

搜索引擎能帮助互联网用户在海量的信息中迅速地找到所需信息,已成为互联网信息检索的一项重要工具,然而在为用户提供方便的同时,也引发了诸多的著作权纠纷.搜索引擎服务商可分为网络服务提供商(ISP)和网络内容提供商(ICP),而ICP作为内容提供者较为容易发生侵权行为,其侵权的方式主要以深层链接和百度快照为主,且目前对搜索引擎服务业侵权责任认定中也存在一定的问题,如《互联网著作权行政保护办法》和《信息网络传播保护条例》的避风港原则的规定,《著作权法》第47条对侵权人的认定等.因此,我们应建立一个利益平衡机制,平衡著作权人、公众以及网络服务商三者之间的权益,同时完善著作权的保护法规和行业自律.

Search engines can help Internet users quickly find the requiredinformation in a very large number of information,and it has become an important tool for information search on the Internet.However,in providing users with convenience,at the same time it also caused a lot of copyright disputes.Search engine service providers can be divided into Internet service providers(ISP)and Internet content providers(ICP). ICP as a content provider is more prone to infringement,and its infringement is mainly based on deep links and Baidu snapshots.At present,there are also some problems in the determination of tort liability in the search engine service industry,for example,the rules for the safe harbor of the Administrative Measures for the Protection ofInternet Copyright and Regulations on the Protection ofthe Spread ofInformation on the Internet,the 47th article of the Copyright Law on the determination of infringers and so on.So,we should establish a balance of interests mechanism,balance the rights and interests among copyright holders,the public,and network service providers,and at the same time improve copyright protection laws and industry self-regulation.
