《国家赔偿法》违宪条款质疑

作为治理国家的基本手段和工具的法治,必须是善法之治。《国家赔偿法》作为我国现代社会法治进程的一项重要内容和基本制度,必须符合法治原则、宪法精神及国际法准则。然而,我国现行《国家赔偿法》的有关条款之规定却不乏违宪之处。为了保障宪法效力的至高性和权威性,维护我国法制建设的统一和尊严,实现宪政宗旨,充分而全面地保护公民、法人和其他组织的合法权益,推动廉政建设,促进依法治国,《国家赔偿法》的违宪条款应予以修订。
