高校学生在实习中的人身权保护探究

由于缺少法律的有效调整,如何在确保高校学生实习权的同时使学生的人身权得到保障一直是一个难以解决的问题。在现阶段,片面强调对实习企业课以过高的义务不具有现实操作性,此时学校应当承担起更多的责任;但从应然层面上看,企业应当尽到相应的社会责任,对实习学生的人身伤害应承担起无过错责任。同时,国家应及时将这种道义责任上升为法律责任。

The exploration on personal rights protection in the practice of college students

Because there is short of legal regulations,how to protect the rights of the students in the practice and their personal rights has always been a difficult issue.Presently,unilaterally emphasizing excessive obligation of the enterprises in which college students practice is not feasible,the colleges should take more responsibilities for the practice,however,based on moral viewpoint,the enterprises should assume corresponding social responsibility and should take no-fault liability for the personal harm of the college students in the practice,meanwhile,Chinese Government should transform this kind of moral and justice responsibility into legal responsibility.
