| 摘 要： | 中国法律吸收了许多译自英美普通法系的法律术语，但在汉英法律翻译过程中，应采取何种策略才能将这些中文术语成功回译到英语中去，目前学界尚未形成定论。借鉴Sperber和Wilson提出的关联理论，尝试从语境（语言语境和非语言语境）、最佳关联、信息意图、交际意图、法律概念和译者术语能力等理论角度解析法律术语的回译策略问题，进而证实将术语回译至原型才能在译语文本中达到最佳关联，保证法律交流更加有效和顺利地进行。

| Abstract: | No consensus has been reached among Chinese legal professionals on how to transtate legal terms introduced from the Common Law system. This paper explores the back-translation strategy of legal terms from the perspective of relevance theory, namely context （linguistic and extra-linguistic）, optimal relevance, informative intentions and communicative intentions, legal concepts and translators＇ terminological competence, thereby arguing that only by tracing the introduced legal terms back to the original forms can the optimal relevance be realized. By so doing, a smooth and effective legal communication could be guaranteed. |
