| 摘 要： | 劳动争议日趋频繁与复杂,但我国的劳动诉讼处理制度相对较落后。通过实证分析和借鉴他国的劳动诉讼制度,提出我国应采取严格条件的"双轨制"的劳动处理机制,制定单独的劳动诉讼法规,并于密集工业区的人民法院下设专门的劳动法庭。

| Abstract: | The labor disputes are becoming multifarious and complicated gradually, but system of the labor litigation in our country falls behind other countries.The article introduces the institution of labor litigation in other countries,adopts the method of substantial evidence analysis,and points out that our country should adopt" two system"of labor-handling mechanism.It also puts forward the suggestion for the related problem within labor litigation system in our country. |
