摘    要:现行《种子法》自2000年施行以来,在规范和推动我国种业发展方面起到了积极的作用。但是,随着社会的发展有些规定已经不能适应现实需要,亟待从立法技术的角度予以修改。《种子法》法律规范结构存在的问题是:法律规范逻辑结构不完整,规范内容与刑法条文衔接不畅,责任条文排列顺序不合理。《种子法》法律语言技术存在的问题是:法律规范表达不严谨不准确,表达自相矛盾,容易产生歧义,表达不清晰、不简练。解决这些问题的方法是:严格按照立法技术标准,规范法律条文的逻辑结构、编排顺序和语言表达。

Abstract:The current Seed Lawplays an active role in regulating and promoting the development of seed industry in China since its enforcement in 2000.However,with the development of society,some stipulations in the law have lagged the need of reality,and they need to be modified urgently from the points of legislation technique.This paper analyzes the problems in legal norms structure of the Seed Law:the logical structure is incomplete,the content does not connect with the criminal law,and the order of legal liability provisions is not reasonable.It also analyzes the problems in legal language technology of the law:the expression of legal norms is somehow imprecise,inaccurate,contradictory,easy to cause ambiguities,unclear and unconcise.It clarifies the correction method for these problems:in strict accordance with the legislative technical standard,arranging legal provisions' logic structure and scheduling order and language expression.
