农村宅基地使用权的流转与退出机制

建立健全农村宅基地流转与退出机制，对于改革集体建设用地使用权制度、保护农民合法权益、缓解城镇化与工业化进程中建设用地供给紧张局面具有重要意义。经济利益驱动、多方需求旺盛、政府强制征收及政策环境驱动、文化传统驱动构成宅基地流转与退出的动力机制，而制度不完善、农民传统观念浓厚、具体退出机制缺失、监督管理工作乏力阻碍了宅基地的流转与退出。宅基地的流转与退出可分层次、分情况进行。

It＇s very important to establish and perfect rural residential land transfer and exit mechanism for the reform of collective construction land use right system, protection of the farmers＇ legal rights, and easing the construction land supply tension in the process of urbanization and industrialization. The paper analyzes the law and policy about rural residential land, its residential security function, social lecture characteristic, actual using state etc; discussing about the drive mecha- nism and hindrance factors to transfer and exit; then giving some policy suggestion to determinate property rights subject, the principle of access to the use right, transfer-level settings, the design of exit mechanism.
