| 摘 要： | 首先分析了人人平等的内在含义,进而以演绎的方式逐渐推导出法律地位上的平等与现实中价值不平等的一致性,以及人身权的平等与人身死亡赔偿不平等的逻辑联系.最后,又从现象与本质的关系入手反过来归纳印证不平等人身死亡赔偿现象的平等本质.全文旨在说明我国人身死亡赔偿制度应该符合民事损害补偿的基本要求.

| Abstract: | The present paper analyses the meaning of the term equality for everyone. Then it deducts step by step to the view that equality in legal status is in conformity of the inequality of value in reality, and the logical relationship between the equality of personal right and the inequal- ity of the compensations for personal death. Finally, the writer inductively testifies the equal na- ture of the unequal phenomena of compensations for personal death by analyzing the relationship between phenomena and essence. The whole paper is to present the view that fits the compensa- tion system for personal death to the basic requests for compensations for civil damages. |
