| 摘 要： | 本文在澄清票据抗辩权和相关概念的含义及区别之基础上,从比较法的角度,分析了票据抗辩权的特征;在对现行票据抗辩事由深入分析的前提下,指出了现行分类存在的缺陷和危害,并对票据抗辩事由进行了新的分类和归纳,以此为基础,还对票据抗辩权的限制进行了具体的讨论。

| Abstract: | From the view of comparative jurisprudence, the paper analyses the features of the right to defense in commercial instrument law on the basis of clarifying its implication and the differences between it and some relevant conceptions. Then the paper classifies and sums up the various defenses in commercial instrument law after pointing out the defects of the classifications in the past. Finally the paper sets forth under what conditions the right to defense in commercial instrument law should be limited. |
