行政立法的经济正当性

运用经济分析法学的理论和方法,对我国行政立法进行成本效益分析,对节约行政立法成本、提高行政立法效益具有重要意义。行政立法应当处理好自身成本与社会成本的关系,重视机会成本、边际成本分析和经济效益、社会效益分析。应当通过树立立法效益意识、健全立法机制、增强立法民主性等途径提高行政立法效益。只有收益大于成本的行政立法才具有经济合理性,而经济合理性是衡量行政立法正当性的重要标准之一。

The Economical Legitimacy of Administrative Legislation

Thetheory and methodology of the scienceof economic analysis isvery useful in the issuesof saving the cost and promoting the effectiveness of administrative legislation in China. It is important in the process of administrative legislation to take into account of itsown costsand its social costs, and pay attention to the analy- sis of opportunity costs, marginal costs and economic and social benefits. The effectiveness of administrative legislation can be promoted by establishing the awareness of legislation, by perfecting its mechanism and by enhancing its democracy. A legislation in the condition of more profits than costs can be economically reason- able. And such a rationality functions asone of the important criteria of theeconomical legitimacy of legislation.
