| 摘 要： | 从公平、公正、效率的原则对无固定期限劳动合同条款存在的问题加以分析，建议加强民主立法，遵循市场规律，健全社会保障体系，并通过制定《劳动合同法》实施细则严格限定无固定期限劳动合同条款的适用，以提升《劳动合同法》实施对社会影响的正效应。
