| 摘 要： | 西汉时期是传统法律发展的关键时期,汉律对传统法律的发展起了承上启下的作用,它上承秦律之精神下启儒家法律化之肇端.传统法律经过西汉时期的发展,在中国形成了"外儒内法"或"儒法融合"的特征,而这一特征也是中华法系的最基本特征.
