| 摘 要： | 环境侵权民事责任归责原则问题,一直是困扰我国法学界的重要理论课题。在探讨制定我国民法典之际,结合我国立法、司法实践和理论研究现状,剖析我国现行环境侵权民事责任归责原则所存在的问题,并借鉴诸外国法相关法律制度的成功之处,仍具有重要意义。

| Abstract: | The issue of the imputation principles of environmental tort of civil liability has been a theoretical question puzzling the law circle of China.It is still significant to discuss this issue at the moment when we set down the Civil Law.The discussion of the problem should proceed in the way of associating the present legal practice and theoretical study,analyzing the present problems of the imputation principles of environmental tort of civil liability,and using successful foreign legal system for reference. |
