| 摘 要： | 重婚在我国司法实务中包括事实上的重婚和法律上的重婚。事实上的重婚为当然无效的重婚,无须由法院宣告无效;而法律上的重婚须经法院宣告才能确定该婚姻自始不发生婚姻效力。前婚的有效终止是法律上的重婚无效宣告的阻却事由,这种终止除了离婚、被宣告无效以及被撤销,还应包括配偶一方的死亡。

| Abstract: | In Chinese juridical practice,bigamy includes factual bigamy and legal bigamy.The marriage in factual bigamy is certainly invalid and does not need to be declared so in court.In the case of legal bigamy,however,the marriage is ascertained to be invalid only after the court's adjudication.The excuse for stopping the announcement of bigamy invalidation is the valid termination of the ex-marriage,which should include the death of the spouse as well as divorce and the announced invalidation and repealing of the ex-marriage. |
