新媒体时代网络舆论监督与司法权独立良性互动机制研究

新媒体时代，网络成为人们参与法治建设、交流讨论典型司法案件、表达观点的平台。处于社会变革时期的中国，司法过程和裁判结果不可避免地受到舆论影响。目前我国舆论监督体系缺乏制度规范，对司法独立产生了负面影响，阻碍社会主义法治建设的进程。网络舆论对司法的监督与司法权独立具有维护社会公平正义的相同价值目标，决定了必须在舆论和司法之间培育起健康的关系。这就需要我们在进行制度建设时寻求网络舆论监督和司法独立的良性互动，既保障开放的舆论空间，又坚持司法权独立运行。

Positive Interaction Mechanism of Network Public Opinion Supervision and Judicial Independence in New Media Era

In new media era, network has become a platform for people to participate in law constitution, exchange and discuss typical judicial cases and express opinions. In the period of social transformation, it is inevitable that judicial process and verdict results are greatly influenced by public opinion in China. At present, there is no effective institutional norm in public supervision system, which has a negative impact on judicial independence and has been hindering the construction process of socialist rule of law. The supervision of network public opinion on judiciary and judicial independence has the same value goal, that is, to maintain social justice, so it is necessary to foster a healthy relationship between public opinion and justice. This requires to seek a positive interaction between network public opinion supervision and judicial independence in institutional construction, which will not only guarantee the openness of public opinion space, but also ensure the independence of judicial power.
