划拨土地流转的法律问题研究

摘    要:目前我国存在大量的划拨土地,由于历史原因,划拨土地中既有被用于公益目的的,也有营利性的.本文将划拨土地与划拨土地使用权二者严格区分开来,坚持划拨土地使用权的公益性和不可流转性.将划拨土地分为存量划拨土地和增量划拨土地,其中的存量划拨土地又区分为公益性用地和经营性用地,存量划拨土地中的公益性用地和增量划拨土地作为划拨土地使用权的载体,不可流转,而存量划拨土地中的经营性用地,则逐步纳入出让土地市场按照价值规律自由流转.

Abstract:There is a large number of assigned land in China at present.Due to historical reasons,the land exists not only for public interest,but also for gaining profit.This essay divided assigned land and the use right of assigned land as two different concepts.The author persisted that the use right of assigned land can only exist for public purposes and the right can not be transferred.The author classified the assigned land as stock assigned land and incremental assigned land.The stock assigned land included land both for public interest and for making profit.Thus,the land exists for public interest and the incremental assigned land must be forbidden to be transferred,while the land used for making profit should be brought into the land market and be gradually transferred freely according to value law.
