电子商务主体责任追溯制度探析

互联网的虚拟性导致电子商务经营主体与现实经营主体之间的对应关系隐性化,交易主体责任难以追溯使网络市场监管面临挑战。对电子商务而言,电子是手段和载体,商务才是本质和核心,电子商务方式上的拓展并不能使其脱离现行法律对商务活动的规制。相关政府部门从主体资格规制的角度对电子商务监管作出了积极探索和实践,但存在制度效力不足、可操作性不强等缺陷。借鉴国外商事登记制度及其对电子商务主体资格规制的经验,应从完善相关立法、坚持电子商务企业主体登记及信息公示、对个人网商实行任意登记、明确网络交易平台开办者的连带责任、推进电子商务主体信用体系建设等方面,对我国电子商务主体责任追溯制度进行重构。

Research on Retroact System of Subject Liability in E-Commerce

The attribute of virtuality in internet has blurred the corresponding relationship between e-commerce operating subjects and physical ones,making it difficult to trace the subject liabilities in e-commerce,and hence the internet market regulation is confronted with challenges.In spite of the application of electronic tools and carriers,e-commerce is no different from its traditional counterpart in that commerce remains to be its essence and core.Therefore,e-commerce still needs to be put under legal regulations just as the normal commerce activities do.The relevant government authorities have made some efforts in improving e-commerce supervision by intensifying regulations on qualifications of e-commerce subjects.However,so far such efforts have been still subject to several major defects including low effectiveness and weak operability.Referring to the experiences of commercial registration systems and e-commerce subject qualification regulations in foreign countries,China need improve the relevant legislation,stick to the practice of e-commerce subject registration and information publicity,apply the voluntary registration system for individual e-traders,define clearly the joint liabilities of internet transaction platform runners,and push forward the construction of credit system of e-commerce subject so as to reconstruct China's retroact system of e-commerce subject liability.
