我国夫妻约定财产制立法完善探究

我国现行的婚姻法对夫妻财产约定的主体、形式、内容、效力等一系列问题做了明确的规定,充分肯定了夫妻约定财产制度在我国夫妻财产制度中的重要地位,将夫妻约定财产制提高到一个新的高度,但是随着我国社会政治经济的进一步发展,婚姻法关于夫妻财产约定在司法实践遇到的问题也逐渐增多。文章以夫妻财产制度的类型之一———约定财产制为切入点,具体阐明我国夫妻约定财产制度内涵和发展进程,在理论上进行充分的探索,以利于该制度在我国今后立法中得以充分的完善。
