理性回归：约束地方政府经济调控行为的法治径路

地方政府的经济调控行为是我国宏观调控体系的重要组成部分。依照现行中央与地方的分权体制,地方政府具有相对独立的经济事权,在追求本地区经济利益最大化的过程中,因其主观偏好而发生经济调控行为的短期性倾向。文章提出,应通过立法监控、程序监控和司法监督,即通过法治约束达到地方政府经济调控行为实现理性回归。

On Limiting Local Governments' Economic Regulations of by Rule of Law

Local governments＇ economic regulation behavior is an important part of Chinese macro-control system.In accordance with the existing division of power between central and local institutions,local governments have relatively independent economic powers in the pursuit of economic interests maximization in the region.Their subjective preferences and behavior of an economic regulation therefore tend to be short-term.This paper suggests that local governments＇ regulating economic behavior be constrained by the rule of law,i.e.,by legislative control,process control and judicial supervision.
