| 摘 要： | 公民医疗权利是在二十世纪以后随着自然法的复兴而在实在法上确立的。作为公法上的权利,其对应的国家医疗保障义务起源于法哲学中关于国家设立目的理论。作为私法上的权利,其基础是自然权利理论,其中医疗自主权起源于康德的法哲学。

| Abstract: | The citizen's medical rights were estabilshed in positive law with the revitalization of natural law in 20th century.On the one hand,the citizen's medical rights are public rights,medical guarantee obligations of the state originated from theory of the state's aim.On the other hand,the citizen's medical rights are civil rights which are based on theory of natural rights.Right of autonomy originated from Kant's philosophy. |
