论和谐社会视阈下的利益冲突及法律调整

中国社会正在由传统向现代转型,各种利益冲突越来越突出.利益冲突具有长期性、普遍性和多样性的特点,现阶段我国的利益冲突表现为利益主体及需求日益多元化;物质利益矛盾居于中心地位,收入差距扩大引发的矛盾突出;社会利益表达机制不健全,导致利益群体矛盾的激化.利益冲突根源于人的利益与利益实现方式之间的矛盾,通过制定和实施规则,抑制和消除利益最大化行为和机会主义行为引起的冲突和对抗,使各利益主体在一定的制度框架内平等有序地实现自己的利益的法律制度,是控制当前社会利益冲突的理性选择.
