罢工权法律保护的经济意义——以“增量利益关系理论”为分析维度

随着我国市场经济的发展，罢工权日益受到关注和重视。我们研究认为，罢工权实际是劳动者集体中止劳动暂时停止创造增量利益的权利，罢工是劳动者实现自己劳动力权益和制衡雇主或用人单位财产权优势滥用的行为。文章运用陈乃新先生的“增量利益关系理论”来解读罢工权法律保护的经济意义，从这个维度分析有利于科学地开发我国丰富的劳动力资源，公正地保障劳动者的经济发展权，从而提高劳动者创造增量利益的积极性，为实现劳资政三方合作共赢关系，构建和谐社会尽绵薄之力。

The Economic Significance of the Legal Protection of the Right to Strike --Inspection of the incremental benefits theory perspective

With the development of China’s market economy,The right to strike is a growing concern and attention.Our study suggests that the right to strike is actually the rights of workers collective suspension of labor temporarily ceased to create incremental benefits.The strike is the acts that the workers realize their labor rights and checks and balances employer or employing unit property advantages of abuse.In this paper,Mr.Chen Naixin incremental benefits theory to explain the economic significance of the legal protection of the right to strike.From this perspective to analysis,it is conducive to scientific development of China ’s abundant labor resources.It is fair to protect workers’ right of the economic development.Thus it is improving enthusiasm of the workers to create incremental benefits.It is of contributing to building a harmonious society for the realization of the labour political tripartite cooperation and win-win relationship.
