论南海海域环境合作保护机制

南海海域环境污染比较严重，现有的环境合作保护机制存在很多问题。由于南海海域的特殊性，其环境合作保护机制的建立应遵循一定的原则，这些原则包括搁置争议，共同保护原则；尊重各国环境主权的原则；合作原则；预防原则；污染者负担原则等。另外，南海海域环境合作保护机制还应借鉴其他海域的环境保护模式，特别是巴塞罗那公约体系，采用框架公约与议定书的保护制度。

The Cooperative Protection Mechanism on the Marine Environment of the South China Sea

The marine environmental pollution of the South China Sea is very serious, and there are lots of prob- lems in the existing cooperative mechanism for environmental protection. In terms of the special features of South China Sea, the cooperative mechanism for environmental protection should be built on the basis of some princi- ples that involve the joint protection while laying aside the disputes, respecting the environmental sovereignty of all the countries, the cooperative principle, the precaution principle and the pellutcr pays principle and so on. In addition, the cooperative mechanism on the marine environmental protection of the South China Sea, while drawing on the modes of environmental protection in the other marine areas, particularly the Barcelona Conven- tion system, should adopt the protection systems of framework convention and protocol.
