试论船舶油污损害赔偿义务主体

摘    要:以传统海事侵权损害赔偿法的单一赔偿义务主体———民事责任人为起点,船舶油污损害赔偿公约及美国油污法均建立起两重赔偿义务主体制度:民事责任人及其保险人和赔偿基金,共同完成对油污损害的赔偿,充分实现损害转移和损害分散。我国也应建立起船舶油污损害两重赔偿义务主体法律制度,以实现对油污损害的充分赔偿。

Abstract:The Civil Liability Convention and the Fund Convention for oil pollution damage as well as the U.S. Oil Pollution Act of 1990, which developed from the traditional law of torts that provided the liable party as the only one to take the obligation of compensation, have constructed two-tier parties to bear the obligation of compensation: the liable party and his compulsory insurer as the first tier and the compensation fund as the second tier. This regime enables the burden of compensation to be shared by the shipping industry and the oil companies, and the victims of oil pollution to get adequate compensation.
