| 摘 要： | 期待可能性在根本上是用来弥补刑法由其理论缺陷所产生的现实非正义的问题,完善刑法的合理性。期待可能性的现实空间仅基于外部原因所造成的期待可能性情形,所以期待可能性的适用领域相对狭小。但是我们从立法和司法角度都可有效借鉴之。 |

| Abstract: | The theory of anticipation possibility is established for the supplement of the practical injustice of criminal law with theoretical defects.Because of the narrow practical application of 'marginal situations caused by the outside reasons,the theory cannot be applied in wide scopes of criminal law.However,this theory still provides us valuable references both in legislation and jurisdiction. |
