从民事公诉的实践困境展望行政公诉制度的建立

目前,无论在我国立法上还是实践中,民事公诉已经"崭露头角",而行政公诉则"前途未卜"。然而,环境民事公诉的实践困境折射出民事公诉在督促行政执法进而维护公益方面难有作为。监督行政是我国检察监督的应有之义,行政公诉更能促进行政执法以维护公益、更契合我国国家机关权力结构和检察机关性质,行政公诉应该大有作为。在即将修改的《行政诉讼法》中,应当确立行政公益诉讼制度,并明确检察机关的原告资格。

On the Outlook of Administrative Public Prosecution from the Practical Dilemma of Civil Public Prosecution

At present,whether in legislation or practice,the civil public prosecution has already＆quot;cut a striking figure＆quot;,and the administrative public prosecution is ＆quot;facing an uncertain future＆quot;. However,practical dilemma of civil public prosecution about environment protection shows that it is difficult for civil public prosecution to supervise administrative enforcement of law and protect public interest.It is the proper meaning of our prosecutorial supervision to supervise administration. Administrative public prosecution can even promote administrative enforcement of law and protect public interest and conform to the power structure of state organs and the nature of procuratorate. Administrative public prosecution will be able to develop its skill to full. We should establish administrative public interest litigation system and explicitly stipulate the plaintiff qualification of procuratorate in the modification of Administrative Procedure Law .
